[CCIT] OSC Policies-SIGNATURE PAGES-Revised

You may remember my spectacularly popular email of 4/2/09 regarding the
new averment on signature pages. Then again, maybe you don't. In either
case, here is the text:

In addition, all of the Signature pages have been revised to add an
averment by the person signing on behalf of the Agency or IHE regarding
Statutory Violations. The new versions of the signature pages will also
be on the website. The purpose of this averment is to obviate the
necessity of sending a Late Memo for contracts that contain the
averment.

Well, Yvonne pointed out a deficiency in the language (it covered
performance but not payment), so the averment was redrafted and now
covers both performance and payment. Assuming this averment is made by
the person signing on behalf of an Agency or IHE, the OSC will not
require a Late Memo. If this averment is not made, then the Late
Justification required by the CONTRACT COMPLETENESS CHECKLIST and the
CONTRACT COMPLETENESS RESOURCE GUIDE is necessary.

 

This change is effective immediately (although you may continue to use
the old versions for any Amendments or Assignments currently in process)
and will be posted on the OSC website soon. A Word versions are attached
for your convenience. Note, the OSC will update the Model Contract
signature pages to reflect this update.
